American Disaster Solutions ("ADS," "we," "us," or "our") reserves the right to modify these terms at any time.
American Disaster Solutions provides emergency disaster response services including, but not limited to:
The scope of specific services will be detailed in individual service agreements or work orders provided at the time of engagement.
Service requests can be made through our website contact form, by phone at (800) 513-5ADS, or by email. Submission of a service request does not constitute a binding agreement. A service agreement is established only upon mutual written or verbal confirmation of scope, timeline, and pricing between ADS and the client.
Response times are estimates based on current deployment capacity, crew availability, weather conditions, and geographic location. While we strive for sub-4-hour response times, actual response may vary during large-scale disaster events.
Payment terms will be specified in individual service agreements. Unless otherwise agreed in writing, payment is due upon completion of services. For insurance-related work, ADS may coordinate payment directly with insurance carriers where authorized by the client. The client remains ultimately responsible for all charges incurred.
Emergency disaster response services are performed under challenging and often hazardous conditions. While ADS exercises reasonable care and follows industry best practices, we cannot guarantee specific outcomes. Our liability is limited to the value of services contracted.
ADS shall not be liable for:
ADS provides documentation services to support insurance claims but does not guarantee claim approval, coverage amounts, or carrier decisions. We are not an insurance company or adjuster, and our documentation is provided as a courtesy to support the claims process. All insurance decisions remain at the sole discretion of the insurance carrier.
Cancellations made before crew deployment will not incur charges. Once crews have been mobilized or materials have been committed, cancellation may result in charges for mobilization costs and materials already allocated. Emergency service cancellations will be handled on a case-by-case basis.
ADS shall not be held liable for failure or delay in performance resulting from acts of God, natural disasters, government actions, civil unrest, pandemics, supply chain disruptions, or other events beyond our reasonable control. In such circumstances, performance obligations will be suspended for the duration of the force majeure event.
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these terms or related services shall be resolved in the courts of Erath County, Texas.
